Terms & Conditions
Last updated: 31 August 2026
These Terms & Conditions ("Terms") govern your access to and use of Smart Inventory, a product photo-to-listing service operated by Emergency Marketing ("we", "us", "our"). By creating an account or using the service, you agree to these Terms. If you don't agree, please don't use the service.
1. The service
Smart Inventory lets you upload photos of products and generates a suggested product title, description, category, selling price, SKU and related listing details using AI. A single free trial listing is available without a credit card. Continued or unlimited use requires a paid subscription as described below.
2. AI-generated content is a starting point
Titles, descriptions, categories, prices and other details produced by Smart Inventory are generated automatically and may be inaccurate, incomplete, or unsuitable for your specific product, market, or marketplace policies. You are solely responsible for reviewing, correcting and verifying any AI-generated content — including price estimates — before publishing, listing, selling, or otherwise relying on it. We make no guarantee that suggested prices reflect fair market value or that generated descriptions are accurate or complete.
3. Accounts
You must provide accurate information when creating an account and keep your login credentials secure. You're responsible for all activity that happens under your account. Accounts are for use by one individual or business; you may not share login credentials to circumvent subscription limits.
4. Subscription, billing & cancellation
The paid plan is billed at $20 AUD per month, charged in advance on a recurring basis to the payment method you provide, via our payment processor, Stripe. You can cancel at any time from your account settings; cancellation stops future billing but does not refund the current billing period unless required by law. We may change subscription pricing with reasonable advance notice; continued use after a price change takes effect constitutes acceptance of the new price.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded.
5. Your content
You retain ownership of the photos and product information you upload. By uploading content, you grant us a limited licence to process, store and display it back to you as part of providing the service, and to send it to our AI and infrastructure providers solely to generate your listings. You confirm you have the right to upload and use any photo or content you submit, and that it doesn't infringe anyone else's rights.
6. Acceptable use
You agree not to use the service to upload unlawful, infringing, fraudulent or harmful content; to attempt to disrupt, reverse-engineer or overload the service; or to use the service to generate listings for prohibited or illegal goods.
7. Service availability
We aim to keep Smart Inventory available and reliable but don't guarantee uninterrupted or error-free operation. The service may be unavailable from time to time for maintenance, updates, or reasons outside our control, including outages of third-party providers we depend on.
8. Limitation of liability
To the maximum extent permitted by law, we aren't liable for indirect, consequential or special losses, or for losses arising from your reliance on AI-generated content, pricing suggestions, or decisions you make based on the service. Our total liability for any claim relating to the service is limited to the amount you paid us in the three months before the claim arose. This clause doesn't limit any liability that can't lawfully be limited.
9. Termination
You may stop using the service and cancel your subscription at any time. We may suspend or terminate accounts that breach these Terms, misuse the service, or fail to pay applicable fees.
10. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we'll take reasonable steps to let you know (such as an email or an in-app notice). Continued use of the service after changes take effect means you accept the updated Terms.
11. Governing law
These Terms are governed by the laws of Australia. Any disputes will be handled in the courts of Australia.
